Actually what scares me is, if, somebody like pxpxgo, suddenly claim that mfm is theirs, and go and copyright the thingy.......
mfm - on the way to being the best community mapping project.

if im not mistaken, the papago map released in MFM cannot be used in iphone's papago software, it has to be tweaked.

i guess papago took our papago map release and reverse engineered, and changed it to a format which fits iphone's papago..

Guys, before you all tembak papago "membabi buta" pls understand the actual situation or we will be in trouble again.

1. Papago has release gps sofware for i-phone developed by them.
2. the gps software is using papago map format
3. MFM provide free papago map format using papago compiler as agreed by papago
4. Papago is giving MFM papago map format free with the sofware
5. Any up-date can only done by papago as the i-phone feature does not allow the user to install other sofware directly (unlike window mobile).
6. The previous administrator is aware on the arrangment based on this posting viewtopic.php?f=39&t=6613 therefore I'm certain that the map supplied by papago for i-phone is legitimate.

Pls practice good judgment before writing any comment as any misrep. of facts may put MFM in hot water.

imantulen wrote:Because MFM's map belongs to nobody, and NOT under protected by any applicable nor enforceable copyright laws, and once released into a public domain such as the INTERNET.... it's FREE for all, public property...... :peace:

And there's NOTHING that MFM can do about it....... (legally-speaking)

On the copyright issue, pls take note that the mapdata and any map released belong to the community. However as the comunity is not a "legal entity", it cannot own the "copyright". Therefore, to protect the copyright, it was agreed that the mapdata "belong' to the mappers on behalf of the community. see this viewtopic.php?p=27604&f=2#p27604.

So, should any party use our mapdata and release gps map in any format without consent, MFM can take action agaist such party via the individual mapper's name.

XXXX & XXXX & XXXX (mappers's real names) .....Plaintifff

vs

XXXXXXXXXXXXXX ......Dedendants

The question now is, are we willing to pay the legal cost on behalf of the mappers or they have to pay it themselves (which is unfair to them)?

So, the responsibility of each mapper entrusted with the duty (or should I call it "liability") is hugh. Seriously I really pitty them. why??

becouse, if one of us used a other people map data to contribute and the mapper used it in our map, the respective mapper is personally liable for such breach of "copyright".

Did you ever use other people data without permission and submit it here as your own for the mappers to use as the source of our map data?

Dear En Badrol,

I would like to think that to avoid such debate, Papago/Maction/MCL/M3 et al, owes the intellectual property owner of the data prior notification of the use of the data in such a manner or when they having done it, they owe the intellectual property owner an explanation of their actions. I think this is the right thing to do, not just out of respect for the members of MFM as a valued partner and out of respect for the ownership of the intellectual property. I would like to think that the legal thing to do is to seek permission BEFORE using data that belongs to some one else.

I do not believe we have any issue about Papago selling the X3/5 or whatever GPS software on the iPhone platform. What we have issue with is the use of MFM data for commercial gains by Papago without specific permission from or notification of MFM.

Even common law does protect the rights of an owner. Just because someone thinks that there is no owner (which I dont agree), does not entitle anyone and everyone to claim ownership. Even the Antarctica needed a UN convention to determine rights and ownership. Hey Antarctica belong to them birds.

In any case, I wonder who elected some members of MFM to become spokesman and defenders of Papago/Maction/MCL/et al.

Sorry to burst your bubble, but the above does not mean a thing.....

think about it - why the need to have 'patent' offices, 'trademark' offices, 'copyright protection conventions - why registration of one's work is so important? - if all, a simple 'I hereby own it' declaration/ disclaimer will do???

btw, if the rip-off is done in Taiwan - do you really stand a ghost of a chance in legal suits....

the internet is full of things, there's a general convention that anything that is uploaded into this 'public domain' on an unrestricted basis, by your own free-will and made available freely to anyone shall become 'public property' if not protected under some form of agreed & enforceable legal conventions. Please note how google went ahead with it's e-book thingy, but backs off on those materials backed by some form of legal enforceable copyright protections....

i agree that there exists what you would call 'professional courtesy or ethics', but remember, it takes two to tango - when the other side don't give two toots to what you think or say.... then it's just as worthless as 'wartime monetary bills'.....
